Welcome to the website www.alphaservis.hr (hereinafter referred to as the “Website”), operated by Mcloud j.d.o.o. (hereinafter referred to as “Mcloud”). By using our website and purchasing products, you agree to the following terms and conditions.
1. General Provisions
These terms define the rules of use of the website, as well as the rights and obligations of users and Alpha Servis.
2. Website Usage
The user must be over 18 years of age or have the permission of a parent/guardian. The user is responsible for the accuracy of the data entered during registration and ordering.
3. Offer and Prices
All prices are expressed in EUR and include VAT. Alpha Servis reserves the right to change prices without prior notice.
4. Warranty
New devices come with a manufacturer’s warranty, while used devices have a 3-month store warranty.
5. Orders and Contract Formation
5.1. Order Process
Orders are placed through the website www.alphaservis.hr. The user selects the desired products, enters the required information, and confirms the order. Before final confirmation, the user has the opportunity to review and modify the order.
Once the user confirms the order, it is considered received when Alpha Servis confirms the receipt of the order via email. This confirmation does not constitute a final confirmation of the sales contract.
5.2. Contract Formation
The sales contract between the user and Alpha Servis is considered concluded when Alpha Servis sends a second email to the user, confirming the order and including details of the ordered products, total price, and delivery terms.
Alpha Servis reserves the right to reject the order if the product is not available, in case of a pricing error, or due to a technical error on the website. In such cases, the user will be notified via email, and any payments already made will be refunded as soon as possible.
5.3. Order Cancellation
The user may cancel the order until Alpha Servis sends the shipping confirmation. Cancellation must be made via email or phone, and Alpha Servis will confirm acceptance of the cancellation.
If the order is canceled after the product has already been shipped, the user will bear the cost of returning the product.
5.4. Product Availability
All orders are subject to product availability. If a product becomes unavailable after an order has been placed, Alpha Servis reserves the right to cancel the order and refund the payment.
5.5. Prices and Payment
All product prices displayed on the website are final and expressed in euros (EUR), including VAT. Shipping costs are not included in the product price and will be specified separately during the ordering process.
The user is responsible for providing accurate payment information, and Alpha Servis will not be liable for payment issues caused by incorrect data entry.
6. Returns and Complaints
6.1. Right to Return Products
In accordance with the Consumer Protection Act, the user has the right to unilaterally terminate the contract and return the product within 14 days from the date of receipt of the product, without providing a reason. The user must notify Alpha Servis in writing (by email or mail) of their intention to return the product before the 14-day period expires.
6.2. Product Return Conditions
The product must be returned undamaged, in its original packaging, with all accompanying documentation, parts, and accessories. The user bears the cost of returning the product unless the product is damaged or does not comply with the order.
Alpha Servis reserves the right to refuse the return of a product if it determines that the product has been used in a way that reduces its market value, except if such use was necessary to determine the nature, characteristics, and functionality of the product.
6.3. Refund Procedure
Once the product has been returned and inspected, the user will be refunded the product price within 14 days from the date Alpha Servis receives the product. The refund will be made using the same payment method used for the purchase unless the user explicitly requests otherwise. Alpha Servis is not required to refund any additional costs incurred due to the user’s choice of a more expensive delivery option.
6.4. Complaints and Warranty
If the product has defects or does not conform to the description, the user has the right to file a complaint. In the case of a justified complaint, Alpha Servis will repair, replace, or refund the product depending on the user’s preference and product availability.
New devices come with a manufacturer’s warranty, while used devices have a 3-month warranty. The user must notify Alpha Servis in writing (via email or mail) of the complaint, and Alpha Servis will resolve the complaint in accordance with applicable legal regulations and as quickly as possible.
6.5. Exceptions to the Right of Return
The user does not have the right to return a product in the following cases:
- If the product was made according to the user’s specific requirements or tailored to their personal needs.
- If the product is, by its nature, non-repairable or perishable.
- If the product is sealed, and after opening the packaging, it is no longer suitable for return due to health or hygiene reasons.
